A CCAA monitor for a Canadian manufacturing entity involved in the auto parts sector
The Debtor’s financial challenges were largely brought on by the failings of its US-based parent company. The Debtor, with the protection of the CCAA proceedings, was able to restructure its business by implementing significant cost cutting measures and revamping its sales activities and continues as a viable supplier to the auto industry.
Trustee under a successful Bankruptcy and Insolvency Act Proposal
On the eve of the Trustee’s appointment, the Debtor, a Canadian manufacturing firm, was on the verge of receivership and in need of re-financing. The Trustee, encouraged the Debtor, in addition to its balance sheet restructuring, appoint a Chief Restructuring Officer to oversee its financial restructuring necessary to enhance the prospects for long term viability. This entity has, with the Trustee’s guidance, successfully restructured its business, both operationally and financially, under the proposal proceedings.
A Trustee in Bankruptcy of a public corporation carrying on business in the mining industry
During the course of administering the bankruptcy, the Trustee was presented with a proposal in respect of a possible reorganization and restructuring of the entity. The Trustee, recognizing that the proposal provided an opportunity to realize a recovery for the Debtor's creditors without risk to the estate, obtained an order from the Court authorizing and directing it to enter into and continue negotiations in connection with this opportunity. These ongoing negotiations culminated in a plan of arrangement and reorganization.
